Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CallHungry (the “Service”), operated by CallHungry (“CallHungry,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CallHungry provides an AI-powered phone receptionist for food and hospitality businesses. The Service answers calls to a phone number provisioned for your business, references the menu and business information you provide, takes orders, and displays them to your staff. The Service integrates telephony, speech, and language-model providers to do this.

2. Accounts

You must provide accurate information when you register and keep it current. You are responsible for all activity under your account and for keeping your login credentials secure. You must be at least 18 years old and authorized to bind your business to these Terms. Notify us promptly of any unauthorized use.

3. Call recording and your obligations to callers

The Service records and transcribes calls placed to your business number so it can take orders, generate summaries, and provide reporting. We include a spoken recording notice at the start of each call. You are responsiblefor ensuring that recording and use of these calls complies with all applicable laws in the jurisdictions where you and your callers are located — including “all-party consent” recording laws — and for any additional disclosures your business is required to make. You are responsible for the accuracy of the menu, pricing, hours, and other information you supply; the Service relays what you configure and may make errors, and final order details, pricing, and timing are confirmed by your business.

4. Your content

You retain ownership of the menu, business information, and other content you provide (“Your Content”). You grant us a non-exclusive license to host, process, and use Your Content solely to operate and improve the Service for you. You represent that you have the rights to provide Your Content and that it does not violate any law or third-party right.

6. Fees, plans, and overage

The Service is offered on monthly subscription plans, each including a set number of call minutes. Usage above your included minutes is billed as metered overage at the per-minute rate shown at sign-up. Subscriptions renew automatically each month until canceled. Payments are processed by our payment provider, Stripe; by subscribing you also agree to Stripe's terms. You authorize us and Stripe to charge your payment method for all fees, including overage. Fees are exclusive of taxes, which you are responsible for. We may change pricing on prospective notice.

7. Cancellation and refunds

You may cancel at any time from your billing settings; cancellation takes effect at the end of your current billing period, and you retain access until then. Except where required by law, fees already paid are non-refundable and included minutes do not roll over.

8. Third-party services

The Service relies on third parties including Stripe (payments) and our telephony and AI/voice providers. Your use of the Service depends on these providers, and their performance and availability are outside our control. We are not liable for third-party acts, outages, or changes.

9. Availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be modified, suspended for maintenance, or discontinued. Phone service, call quality, and AI responses depend on networks and providers we do not control.

10. Intellectual property

The Service, including its software, design, and branding, is owned by CallHungry and protected by law. These Terms grant you a limited, non-transferable right to use the Service and no other rights.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the AI will take orders without error or that the Service will meet your requirements.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLHUNGRY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You will indemnify and hold harmless CallHungry from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your orders and transactions with your customers, or your violation of these Terms or applicable law (including call-recording and telemarketing laws).

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including fees owed, disclaimers, limitation of liability, and indemnification) survive.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, additional notice. Continued use after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of the United States and the state in which CallHungry operates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, and you consent to that jurisdiction.
